Privacy Policy

By accessing or using FreeMix, or uploading or downloading any Content therefrom, you agree to be legally bound by this Privacy Policy, our Terms of Service, any other terms and conditions disclosed on the FreeMix Platform, and the terms and conditions of any and all Licenses granted or obtained on the Platform.

1. What We Collect / Notice at Collection

Information you provide:

  • ATProto DID and handle (via OAuth authentication)
  • Profile information: display name, bio, avatar, genres, roles, PRO affiliation
  • Track and stem metadata: titles, descriptions, genres, tags, BPM, key
  • License selections for your content
  • AI declaration information

Information collected automatically:

  • IP addresses (server logs)
  • Download records (who downloaded what, when)
  • Playback data (play counts)
  • Activity data (likes, reposts, follows, shares)
  • Audio fingerprints (Chromaprint, for future duplicate detection)
  • Browser and device information (standard HTTP headers)

Information we do NOT collect:

  • Passwords — authentication is handled by your ATProto identity provider
  • Payment information — no commerce features in the current phase
  • Precise location data beyond IP-derived approximate location

2. How We Use Your Data

We use your data to:

  • Operate the platform: host content, serve streams, generate waveforms
  • Display your profile and content to other users
  • Build remix attribution chains and provenance records
  • Generate activity feeds
  • Audio fingerprinting for future content matching and duplicate detection
  • Platform analytics, enhancements, and improvement
  • Respond to legal requests and enforce our terms
  • Develop, test, evaluate, troubleshoot, and improve new and existing products, services, and features
  • Promote safety and security on the platform by assisting us in verifying accounts, account activity, and users

3. How Your Data Is Stored

Our infrastructure:

  • PostgreSQL on Railway (US) — metadata, user profiles, activity records
  • Cloudflare R2 (global) — audio files, cover art, waveform data
  • ATProto PDS — your records (tracks, stems, licenses, attributions) live on YOUR Personal Data Server, not ours. We index copies for search and display.
  • FreeMix is a global platform, and your information may be stored and processed in various locations. By using FreeMix, you acknowledge and consent to the transfer of your information to the United States and other jurisdictions where data protection laws may differ from those in your home country.

ATProto data ownership:

Your ATProto records are portable — they belong to you, stored on your PDS. If you leave FreeMix, your ATProto identity and records go with you.

FreeMix maintains an index of your records for platform functionality. Deleting content from FreeMix removes it from our index and storage, but your PDS record management is handled by your ATProto provider.

We are not responsible for the privacy practices, data security, or record management of your chosen PDS provider. Your relationship with your PDS provider is independent of FreeMix, and we encourage you to review their specific privacy policy to understand how they handle your data.

4. Data Sharing

We do NOT sell your data.

We do NOT serve advertising.

We share data with:

  • Cloudflare — CDN, R2 storage, DNS (their privacy policy applies)
  • Railway — database hosting (their privacy policy applies)
  • Other FreeMix users — your public profile, tracks, and activity are visible to other users as part of the platform's core functionality
  • Law enforcement — only when required by valid legal process

ATProto is an open protocol — records you create are accessible to other ATProto applications by design. This is a feature of the decentralized web.

5. Cookies & Sessions

  • We use session cookies for authentication
  • We do not use advertising or tracking cookies
  • No third-party analytics cookies
  • The law allows you to limit or otherwise opt-out of our sharing of personal information about you in certain circumstances. In particular, you may direct us to prevent the sharing of your information to certain third-parties. However, we do not currently share information about you with any non-affiliated third-parties that would trigger this opt-out right.
  • The FreeMix Platform may contain links to other apps or websites. We are, of course, not responsible for the privacy practices of other apps or websites. We encourage visitors to be aware when they leave the FreeMix Platform and to read the privacy statements of each and every app or website that collects personally identifiable information. This Privacy Statement applies solely to information collected by FreeMix.

6. Data Retention

  • Account data: Retained while your account is active
  • Content (tracks, stems): Retained until you delete them
  • Download records: Retained indefinitely (part of the provenance chain)
  • Activity data: Retained indefinitely
  • Server logs (IP addresses): Retained for 90 days
  • Audio fingerprints: Retained indefinitely (for content matching)

7. Your Rights

  • Access: You can view your data through your profile and activity feed
  • Correction: You can edit your profile and track metadata at any time
  • Deletion: You can delete your tracks and stems. Note: content already downloaded by others under valid licenses remains licensed. Download records are retained as part of the provenance chain.
  • Data export: Your ATProto records are inherently portable via the AT Protocol

8. Children's Privacy

FreeMix is not intended for users under 18 years of age. We do not knowingly collect data from minors. If we learn that we have collected data from someone under 18, we will delete it promptly.

9. Changes to Privacy Policy

We may update this Privacy Policy from time to time. Material changes will be communicated via the platform. Check this page for the latest version.

11. Dispute Resolution & Governing Law

This Privacy Policy and any dispute between you and us related thereto will be governed by Illinois law without regard to its conflict of law provisions. Before filing a claim against Studio.Bio Creative LLC, you agree to try to resolve the dispute informally by contacting contact@freemix.fm. We will try to resolve the dispute informally by contacting you via email at the email address you have provided. If a dispute is not resolved within thirty (30) days of submission, you or Studio.Bio Creative LLC may bring a formal proceeding.

You agree to resolve any claims relating to this Privacy Policy through final and binding arbitration in Lake County, Illinois. This includes disputes arising out of or relating to the interpretation or application of this "Dispute Resolution" section. You may only resolve disputes with us on an individual basis and may not bring a claim as a plaintiff or a class member in a class, consolidated, or representative action. Class arbitrations, class actions, private attorney general actions, and consolidation with other arbitrations are not allowed.

The aforementioned notwithstanding, we may bring a lawsuit for injunctive relief to stop unauthorized use or abuse of the FreeMix Platform, intellectual property infringement, or any other violation of our terms and conditions, without first engaging in arbitration or the informal dispute-resolution process described above, and in the event of such a lawsuit, you agree to submit to the exclusive personal jurisdiction of the State and Federal Courts of Lake County, Illinois.
